CyberBike Store Terms
Terms of Service
These Terms govern your access to the CyberBike website and your purchase and use of products and services available through our store.
1. About CyberBike
CyberBike is an online retailer specialising in electric bikes and related accessories. References in these Terms to “CyberBike”, “we”, “us”, or “our” mean the operator of this online store.
Our store is powered by Shopify, which provides the ecommerce platform used to display products, process orders, and make our services available to you.
2. Acceptance of These Terms
By visiting the website, creating an account, placing an order, or otherwise using our services, you confirm that you have read and agree to these Terms and the policies referenced within them.
If you do not agree to these Terms, you should not use the website or place an order.
3. Eligibility
To place an order, you must have the legal capacity to enter into a binding contract. If you are under 18, an order must be placed by a parent, guardian, or another responsible adult who agrees to these Terms.
4. Customer Information and Accounts
You agree to provide current, complete, and accurate information when placing an order or creating an account. This includes your name, email address, billing information, delivery address, and any other information reasonably required to fulfil your order.
You are responsible for keeping account login details confidential and for activity carried out through your account, except where unauthorised activity results from a failure by CyberBike to use reasonable care.
Contact us promptly if you believe your account or payment information has been used without permission.
5. Products and Product Information
We take reasonable care to present product descriptions, images, specifications, colours, dimensions, compatibility information, and availability accurately.
Screen settings, lighting, product updates, and manufacturing tolerances may cause minor visual or dimensional differences that do not materially affect the product. Any material differences remain subject to your applicable consumer rights.
Product availability may change. Displaying a product on the website does not guarantee that it will remain available until an order is accepted.
6. Prices and Payment
Product prices are shown in the currency displayed at checkout. Any applicable taxes, delivery charges, discounts, and final order total will be displayed before you submit your order.
You agree to provide valid and authorised payment information. Payments may be processed by Shopify Payments or another payment provider displayed at checkout.
We may correct an obvious pricing or product-information error before accepting an order. If payment has already been taken for an order we cannot accept, the amount paid will be refunded to the original payment method.
7. Orders and Contract Formation
Submitting an order is an offer to purchase the products in your basket. An automated order acknowledgement confirms that we received your order but does not necessarily mean it has been accepted.
A purchase contract is formed when we confirm acceptance, dispatch the product, or otherwise begin fulfilling the order, whichever occurs first.
We may decline or cancel an order before acceptance for legitimate reasons, including unavailable stock, an obvious pricing error, failed payment authorisation, suspected fraud, delivery restrictions, or an incorrect product listing.
If we cancel an order after receiving payment, we will refund the affected amount to the original payment method.
8. Order Changes and Cancellations
If you need to change or cancel an order, contact us as soon as possible. We will try to help, but we cannot guarantee that a change or cancellation can be completed after processing or dispatch has started.
Your statutory cancellation rights and our 30-day commercial return policy remain available as described in our Return & Refund Policy.
9. Shipping and Delivery
Available delivery methods, charges, and estimated delivery timeframes are shown on the website, at checkout, or in our Shipping Policy.
You are responsible for providing a complete and accurate delivery address and for informing us promptly if you notice an error. Address changes may not be possible after dispatch.
Delivery estimates are not guaranteed dates unless expressly agreed otherwise. We will inform you of material delays and provide the options required by applicable law.
10. Returns, Refunds and Consumer Rights
Returns, exchanges, cancellations, and refunds are governed by our Return & Refund Policy and applicable UK consumer law.
Products supplied to consumers must meet the standards required by law, including being of satisfactory quality, fit for their intended purpose, and as described. Nothing in these Terms removes or restricts those rights.
11. Electric Bike Safety and Lawful Use
Electric bike rules may vary according to product specifications, location, rider age, road classification, and intended use. Certain models or operating modes may be restricted to private land or require registration, insurance, licensing, protective equipment, or other legal measures.
Before using a product, you should review its specifications, instructions, warnings, and applicable local rules. Products must be assembled, charged, maintained, and operated according to the supplied guidance.
This section does not limit CyberBike’s responsibility to supply products that comply with legal requirements applicable to their sale.
12. Acceptable Website Use
You may use the website only for lawful personal or business purposes. You must not:
- Use the website for fraudulent, unlawful, abusive, or misleading activity.
- Attempt to gain unauthorised access to the store, accounts, systems, or data.
- Upload or transmit malicious code, viruses, or harmful technology.
- Interfere with the security, availability, or proper operation of the website.
- Collect personal information about other users without lawful authority.
- Use automated tools to overload, scrape, copy, or disrupt the website in a manner that harms CyberBike or other users.
- Impersonate another person or misrepresent your identity or authority.
- Use website content in a way that infringes intellectual property or other legal rights.
13. Reviews, Feedback and User Content
If you submit a review, photograph, comment, suggestion, or other content, you confirm that you have the right to provide it and that it is accurate, lawful, and does not infringe the rights of another person.
You grant CyberBike a non-exclusive, worldwide, royalty-free licence to display, reproduce, format, and use submitted content for operating, promoting, and improving the store, subject to applicable privacy and consumer law.
We may moderate or remove content that is unlawful, abusive, misleading, irrelevant, infringing, or contains personal or confidential information. We will not suppress a genuine review merely because it is negative.
14. Intellectual Property
Website content—including branding, text, graphics, product presentation, layouts, logos, photographs, videos, icons, and software—is owned by CyberBike, licensed to CyberBike, or used with lawful permission and is protected by applicable intellectual property law.
You may access and use the website for personal shopping purposes. You must not reproduce, modify, distribute, sell, publish, or commercially exploit protected content without prior permission from the relevant rights holder.
15. Third-Party Services and Links
The website may use or link to independent services provided by Shopify, payment providers, delivery companies, social networks, or other third parties.
Third-party services may have their own terms and privacy policies. CyberBike is not responsible for independent websites or services that we do not own or control, but this does not affect any responsibility we cannot legally exclude.
16. Website Availability
We aim to keep the website accurate, secure, and available, but uninterrupted access cannot be guaranteed. Maintenance, updates, technical problems, security events, or matters outside our reasonable control may temporarily affect the website.
We may update, suspend, or withdraw website features where reasonably necessary, provided this does not remove rights attached to an order already accepted.
17. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, and your statutory rights relating to faulty, misdescribed, or non-compliant goods.
If you are a consumer, CyberBike is responsible for losses that are a foreseeable result of our breach of these Terms or failure to use reasonable care and skill. A loss is foreseeable if it was an obvious consequence or was contemplated by both parties when the contract was formed.
CyberBike is not responsible for losses caused solely by your misuse, unauthorised modification, failure to follow product instructions, or events outside our reasonable control, except where applicable law provides otherwise.
18. Privacy
Our collection and use of personal information are explained in our Privacy Policy. By using the store, you acknowledge that your information will be handled as described in that policy and according to applicable law.
19. Changes to These Terms
We may update these Terms to reflect changes to our store, services, technology, or legal obligations. The current version will be published on this page.
Changes will not remove contractual or statutory rights that already apply to an accepted order. Continued use of the website after updated Terms are published means the updated Terms apply to future use and future orders.
20. Severability and No Waiver
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
If CyberBike does not immediately enforce a provision, this does not mean that we permanently waive the right to enforce it.
21. Governing Law and Disputes
These Terms and contracts formed through this store are governed by the laws of England and Wales.
If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory protections and rights to bring proceedings in the courts available to you under applicable law. We encourage you to contact us first so we can try to resolve any concern directly.
